Court gives ultimatum on Nyako’s reinstatement
Tribulation judge, Justice Okon Abang, after substantiating accommodation of the processes in the suit on the defendants, verbally expressed the defendants would have up until 3pm on September 8 to insert obligatory defence to the suit.
The defendants are Umaru Fintiri (sued as the Acting Governor of Adamawa State), Adamawa State House of Assembly, Chief Judge of the Adamawa State, Ambrose Mammadi, chairman of the seven-member panel that investigated allegations of gross malfeasance against Nyako, Buba Kajama, the Independent National Electoral Commission (INEC) and the Inspector-General of Police.
According to the suit, Ogungbeje is seeking a declaration that the establishing of the panel by Mammadi, after his order ceasing the Adamawa State House of Assembly from constituting the panel, was inequitable, malafide, unlawful, illicit and a breach of Nyako’s right to fair auricularly discerning and fair tribulation as ensured under Section 36 of the 1999 Constitution (as amended).
Besides, the applicant is urging the court to nullify Nyako’s impeachment of July 15, 2014 and another order compelling Fintiri to vacate office as Acting Governor.
Apart from the fact that Nyako was not personally accommodated with the impeachment notice, Ogungbeje further stressed that Nyako was additionally not accommodated with a replica of aurally perceiving notice by the seven-member panel chaired by Kajama.
